The National Court has declared « according to law » the decision of the Ministry of Justice to deny Spanish nationality to an employee of the Moroccan Consulate in Seville and resident in that city, according to a report from the National Intelligence Center (CNI) that confirms its « close collaboration with the Headquarters of the Moroccan Intelligence services stationed in Spain ».
Specifically, in a ruling issued on September 14 and collected by Europa Press, the Contentious Chamber of the National Court addresses an appeal by a man of Moroccan origin, against a resolution issued in 2019 by the Ministry of Justice, denying him Spanish nationality for « reasons of public order or national interest » .
According to the Ministry of Justice, this man » has not justified the good civic conduct that article 22.4 of the Civil Code requires , since according to the mandatory report in the file, the interested party does not accredit said requirement due to reasons of public order or national interest », weighing « proof of his close collaboration, since his arrival in 2016 at the Moroccan consulate in Madrid as a local agent , with the current head of the Moroccan Intelligence Services in Spain ».
Spanish children, « good conduct » and « adapted » to Spain
Faced with this, the aforementioned man maintained in his contentious appeal against said refusal resolution, that he is married to a Moroccan citizen nationalized as Spanish and has two children, » both with Spanish nationality » ; that he « worked since 2010 as an interpreter for the General Consulate of Morocco in Seville »; that the Public Prosecutor « does not oppose the granting of Spanish nationality »; that the Seville Civil Registry confirms that this person « knows the Spanish language, has good conduct, has adapted to the Spanish lifestyle and life, and has means of livelihood »; in addition to the fact that the National Police has issued reports according to which « there is no record » of the police on this man.
Thus, in his appeal he claimed the « unanimity » of voices in favor of his « good civic conduct », with the exception of a report from the National Intelligence Center (CNI), which in his opinion does not detail a « collaboration » activity with the Moroccan Intelligence and « does not specify any chronological, spatial or geographical delimitation that allows the defense ». « The inaccuracy of the report prevents prosecution in order to assess the impact of the activity on national security, » he claimed, claiming the annulment of the resolution denying Spanish nationality and the granting of it.

However, the National Court indicates that « the content of the CNI report is expressive enough. Through it, the CNI alludes to the plaintiff’s activities as a local agent of the Moroccan Intelligence Services . » « This circumstance, together with the fact that the plaintiff has been providing services at the Moroccan Consulate in Seville, either as an interpreter or as an official, evidences the close ties of the interested party with his country of origin, confirming what was reported by the CNI. » argues the National Court.
« The CNI report, together with the rest of the file and the reasons offered by the Administration (…) clearly express what the activity of the interested party is that allows one to question the relevance of accessing the nationality request, for reasons of public order and national security, a circumstance that becomes clear when the facts stated are stated: that the plaintiff carries out his work at the Moroccan Consulate in Seville and that the CNI verifies close collaboration with the Headquarters of the Moroccan Intelligence services stationed in Spain. such conditions it is clear that the refusal decision was fully justified », settles the National Court, which thus dismisses the contentious appeal of the aforementioned and declares « according to law »the decision denying your request for the granting of Spanish nationality.
